1. PRICE INCLUDES
We attempt to make every effort to ensure that our clients are fully aware of what costs are involved ineach trip, and to avoid any surprise hidden costs. Our prices include transport for the duration of thetour, accommodation, group equipment (tents, pots, etc.) hire costs (boats, polers, etc.), permitsand entry fees, competent professional guides and all food for the duration of the trip (restaurantsexcluded). The food is healthy and every endeavour is made to suit all tastes, and we make as muchuse of local produce as possible. We include coffee and tea, as well as fruit juice at breakfast, but all alcohol and soft drinks are for your own expense. DRIFTERS do not operate the food kitty system, because this causes delays during the journey while the passengers shop, and is open to misuse. All braais and breakfasts are provided by us but not meals en route to and from the area of the tour. As our programme must be projected so far ahead and our prices are therefore subject to exchange rate fluctuations, we reserve the right to surcharge without notice, although this is against our intentions. Any special extra excursions are for the client’s expense.
2. BOOKING PROCEDURE
If you wish to make a reservation it is advisable first to contact your agent or DRIFTERS to ensure that there is still space available on the particular venture or tour. If so then complete the booking form and send it along with a 10% NONREFUNDABLE deposit to confirm your reservation. IF THE FULL AMOUNT IS NOT PAID AS STIPULATED BY YOUR AGENT OR PRIOR TO DEPARTURE DATE OF SUCH TOUR/VENTURE, DRIFTERS may, at our own discretion and without notice, be entitled to regard the booking as cancelled and to re-book the vacancy. Late applicants may join tours/ventures on an accommodation available basis.
3. INSURANCE
Travel insurance is compulsory and you should arrange such in your country of origin. You should be covered in the event of cancellation or curtailment, death, any medical or rescue expenses, as well as for any loss of baggage, money or personal items. You may contact our office in this regard.
4. CANCELLATION PROCEDURE
Cancellation of any booking must be received in writing and acknowledged by DRIFTERS. If a booking is cancelled with the consent of DRIFTERS, the latter shall retain the full deposit. Should a person cancel a tour/venture and cannot find an immediate replacement:
a) If DRIFTERS have 4 weeks or more notice, only the deposit is forfeited.
b) If DRIFTERS have less than 4 weeks notice, the deposit and in addition a cancellation fee
will be payable by the client as follows:
27-21 days 40% of total fare
20-14 days 60% of total fare
13-0 days 100% of total fare
c) If you fail to join a tour/venture or join it after departure, or leave it prior to its completion, no reimbursement whatsoever will be made.
5. TRANSPORT
DRIFTERS operate with Mercedes trucks, Mercedes vans, Landcruisers, Samils and Unimogs, all chosen for their practicality and reliability. They seat up to 17 clients depending on the application.
6. GROUP SIZE AND AGE
Our group size usually numbers between 6 and 17 clients. By travelling in small groups it means that we don’t invade campsites and can avoid wasting time in constantly having to wait for people. It also enables us to maintain a far more personal service to our clients. From our experience our groups are normally made up of individuals, couples and sometimes groups of friends aged between 18 and 55 years. The sheer physical and youthful mentality which prevails on these tours makes them generally unsuited to anybody over the age of 55 years.
7. CHANGE OF BOOKING
If, after confirming your booking, you wish to change to an alternative departure date, you may do so subject to availability and by agreement with our booking office. An amendment fee will be charged. Should we not be able to accommodate your request and you therefore must cancel, our usual cancellation procedure will apply.
8. EXCHANGE CONTROL REGULATIONS
Clients must realise that most African countries have certain currency restrictions with which they must familiarise themselves before travelling.
9. RESCUE AND MEDICAL ASSISTANCE
In the unlikely event of rescue and medical assistance being needed, other than that provided by DRIFTERS, the participant shall be liable for the entire cost thereof, unless covered by insurance.
10.PARTICIPATION
The degree of satisfaction and enjoyment you feel at the end of each day and the end of the trip will depend on you and your capacity to enjoy yourself. This capacity, combined with an active and enquiring mind and a willingness to participate, is essential for all our tours. If you wish to be pampered and amused with minimal effort on your part, then our tours are not for you. Participation is essential on all trips and everyone is expected to help with chores to ensure the smooth running of the tour. A degree of flexibility is also essential because of the nature of the parameters in which we have to operate.
11.GUIDES
Our guides are mature adults who are young at heart and enjoy their work. They are chosen for their personalities, their interest in their environment, their experience and their ability to handle people. We have a hard core of full-time guides as well as a pool of good reliable parttimers, all registered with the Field Guides Association of Southern Africa and South African Tourism .
12. SLEEPING
Usually in tents accommodating two adults. Alternatively we utilise Inns, log cabins, bungalows and rondavels, and under the stars, if desired. Thin sleeping mats are provided, but clients may bring inflatable mattresses for further comfort. Single clients may share accommodation with other clients.
13. LUGGAGE ALLOWANCE
Baggage on all our tours will be strictly limited to one large bag (barrel bag or internal framed backpack), weighing a maximum of 15kgs. We will also allow a smaller hand luggage bag or camera bag per person. In order to prevent complications on vehicles, aeroplanes and boats, this allowance must be adhered to. SUITCASES WILL NOT BE PERMITTED.
14. EQUIPMENT HIRE
We hire out sleeping bags if required. (See booking form.)
15.SPENDING MONEY
Each trip will require differing amounts of pocket money depending on the length of the journey, the individual’s needs and the specific conditions of each tour. Money is needed for meals en route on the first and last day of travelling, curios, alcohol and soft drinks, specified restaurant meals, visas, airport taxes, transfers and additional excursions, not included in the tour price. Tipping is a customary practice in Southern Africa.
16. KIT LIST AND FINAL INSTRUCTIONS
On receipt of your deposit we will send you a suggested kit list, which will supply you with a guide as to what to bring along as well as further useful information. You will also receive a receipt confirmation which must be read carefully as it will display both the time and point of departure and return.
17. ACCEPTANCE OF BOOKING CONTRACT
A contract between DRIFTERS and the client will only be deemed to be concluded once the client or the client’s agent has received receipted notification from DRIFTERS. Clients will be required to sign an acceptance of contract before starting their tour. The place of conclusion of contract will always be taken as South Africa and any claim or actions brought against DRIFTERS can only be made under South African jurisdiction.
18. AIR TRANSPORT
DRIFTERS will assist with any flight bookings and arrangements if requested. We will always endeavour to obtain the best prices possible, but we accept no liability regarding delays, cancellations or any other problems in this regard whatsoever. Passenger tickets in use by the specific airline when issued shall constitute the sole contract between the airline and the passenger.
19. CONDITIONS
Due to the nature of hiking, camping, touring, driving and the general third-world conditions on our tour/ventures, DRIFTERS, their employees, guides and affiliates, do not accept responsibility for any client or dependant thereof in respect of any loss, injury, illness, damage, accident, fatality, delay or inconvenience experienced from time of departure to time of return, or subsequent to date of return, such loss, injury, etc. arising out of any such tour/venture organised by DRIFTERS. Should a tour/venture be cancelled by DRIFTERS due to weather conditions or other reasons, it shall either refund full payment or offer a substitute tour/venture. Should DRIFTERS have to curtail a tour/venture for any reason due to weather conditions or other factors after the time of departure, DRIFTERS will not be liable for any form of refund whatsoever, although everything will be done to complete a tour/venture or to utilize an alternative arrangement or venue. Should a client decide to curtail a tour for any reason whatsoever, DRIFTERS will not be liable for any refund whatsoever.
Nomad
Nomad Adventure and Holidays (Pty) Ltd Reg. No. 2000022176/07 herein after referred to as ‘the Company’ accepts bookings subject to the terms and conditions outlined herein, which agreement shall be the whole agreement between the parties:
1. THE BOOKING
- This booking and subsequent contract shall be deemed to have been concluded in Cape Town, South Africa and shall be interpreted according to the laws of the Republic of South Africa.
- The parties consent to the jurisdiction of the Magistrates Court of Cape Town in terms of the provisions of Section 45 of Act 32 of 1944 as amended but it is speci?cally agreed that the Company at it’s instance will have the discretion to sue in the High Court if it deems is appropriate.
- All prices and services are correct at the time of printing. All prices, services and departures are subject to change without prior notice.
- The Company reserves the right to alter the published price of any tour due to increasing tariffs, costs and entry fees or ?uctuation of exchange rates, such amounts shall be determined at the sole discretion of the company.
- Nomad will not accept any booking where the booking or indemnity form is unsigned or incomplete in any respect.
- The Company reserves the right to decline any booking without outlining its reasons therefore.
- No booking shall be considered con?rmed until a written con?rmation slip has been sent to the agentclient and the full amount due paid and all cheques honoured.
2. DEPOSIT & PAYMENT
- A non-refundable 25% deposit is required to secure a booking. This amount forms part of the payment for the trip and shall be offset to the total amount charged to the clientagent.
- If the full amount is not paid by fourteen (14) working days prior to departure, the Company reserves the right to treat the booking as cancelled and the deposit shall be forfeited.
- Passengers booking within fourteen (14) days of tour departure are required to pay the full amount immediately to secure the seat.
3. CANCELLATIONS
- In the case of a booking cancellation, the Company shall retain the full deposit. If a booking is cancelled less than twenty-eight (28) days prior to the tour departure date, then the client is subject to a cancellation fee as follows:
22 to 28 Days 40% of Total Fare / 15 to 21 Days 60% of Total Fare
08 to 14 Days 80% of Total Fare / 0 to 07 Days 100% of Total Fare
Any passenger joining a tour after the departure date, or not at all, or leaving before the completion of the tour for any reason whatsoever, is not entitled to any refunds whatsoever from the Company, or entitled to claim any costs for any added expenses.
- The Company reserves the right to cancel any tour at its sole and absolute discretion, without prior noti?cation in instances where this is unavoidable. However, in this instance the Company agrees to refund all monies already paid by the client. This shall be the Company’s sole responsibility to the client and no claim for any damages, howsoever arising, shall accrue against the company.
- Tours are subject to a minimum booking of ?ve (5) passengers. If that number is not obtained, the Company reserves the right to cancel the tour. A full refund would then be payable to all booked clients.
4. PASSPORTS, VISAS AND OTHER TRAVEL PAPERS
- It is the client’s sole responsibility to ensure that passports, visas, health certi?cates, proof of vaccinations and any other required documentation are all in order for the countries to be visited.
- The Company cannot be held liable for any consequences, damages or claims if the client prior to commencement of the tour does not correctly attend to the client’s documentation and related matters.
5. INSURANCE
- Comprehensive travel and cancellation insurance is mandatory on all tours. It is the client’s responsibility to ensure that they have this insurance in place and the required paperwork to prove such before embarking on the tour.
- Any resulting consequence of not having this paperwork is the sole responsibility of the client.
6. BAGGAGE
- All baggage and personal effects are at all times the client’s responsibility and the Company does not accept any liability for any loss or damage of any personal effects, howsoever arising.
- Clients are entitled to one bag of not more than 20 kg and a daypack. Should the client require a larger baggage allowance, this can be arranged at the discretion of the Company and on payment of a fee that the company may levy. The Company retains the right to refuse excess baggage.
7. RISK
- The client accepts that all tours are of an adventurous nature and involve an element of personal risk. Neither the Company nor any of its agents shall be held liable in any way for any injury, loss of life or damage to property, howsoever caused and the client hereby indemni?es and holds the company, its agent, assigns and servants harmless from any such claim.
- The client accepts full responsibility for all risks involved.
8. HEALTH
- The client accepts that to participate in the tour requires a measure of physical ?tness and health and it is the client’s obligation to ensure that they are medically ?t to embark on the tour.
- We do however require a medical certi?cate or doctor’s letter in respect of all clients over age 65, con?rming that they are medically ?t to undertake the tour.
9. AUTHORITY ON TOUR
- The decisions of the Company’s guidedriver on tour shall at all times be ?nal and binding.
- The client must at all times comply with the laws, customs and foreign exchange regulations of all countries visited.
- Should the client be in any contravention of the above or the client is a nuisance to the group the driver/guide may order the client to leave the tour without any claim to a refund. The client shall be obliged to make their way home at their own expense.
10. MARKETING
- The Company reserves the right to use any photographs and video taken during tours for use in marketing or any other advertising material and the client hereby gives consent of such photographs to be used and for the company to retain copyright over such photographs to be used and for the Company to retain copyright over such material.
11. FORCE MAJEURE
- Unforeseen circumstances including but not limited to war, mechanical breakdowns, weather, riots and other unforeseen reasons beyond the control of the Company may cause delays or alterations to the tour. The Company shall not be held liable in any way for any of these possible occurrences or any consequences, which may arise as a result of these.
Sunway Safaris
1. DEFINITIONS
- SUNWAY SAFARIS cc CK 94/3921/23 is hereinafter referred to as "SUNWAY" and the person who accepts the boooking by signature is hereinafter referred to as the "CLIENT". This booking and subsequent contract between the client and Sunway shall be deemed to be concluded in the Republic of South Africa, subject to the terms and conditions reflected herein
2. BOOKING
(a) When SUNWAY send off the confirmation invoice to the applicant, or the travel agent through whom the application was made, the booking shall be confirmed and accepted by SUNWAY. Please note that reservations cannot be made without a deposit.
(b) The balance of the fare is due SIX (6) weeks prior to the date of departure.
(c) All tours are subject to a minimum of 6 (six) pax travelling, although a tour may be run with fewer at the discretion of SUNWAY.
3. DEPOSITS
- A deposit of 20% per person is required when submitting the completed booking form. The deposit is accepted as part of the inclusive fare and will only be refunded if the applicant cannot be accommodated.
4. CANCELLATIONS
- Cancellation of bookings by the client must be made in writing and is effective from the date it is received by SUNWAY. The following cancellation fees will be payable by the client::
> 41 days = deposit only
41 - 14 days = 60% of total fare
13 - 0 days = 100% of total fare
Should a client fail to join a tour or join late or fail to complete a tour, no refund shall be made or liability be accepted by SUNWAY.
5. REFUNDS
No refunds shall be made by SUNWAY for any reason whatsoever, and neither will it accept any claims of any nature including consequential damages as a result of any accommodation or other facilities made or becoming unavailable on tour. The client hereby indemnifies and holds SUNWAY harmless in respect of such claim.
6. SUNWAY reserves the right to cancel any tour without prior notification. In such event, all monies paid will be refunded in full which shall constitute the full extent of SUNWAY's liability to the client.
7. AUTHORITY ON TOUR
(a) The client acknowledges that the SUNWAY shall appoint a tour leader who shall be in charge of the tour and all matters relating thereto, and the client agrees to comply with the tour leaders' lawful requirements.
(b) The client must at all times comply strictly with the law, customs and foreign exchange regulations of all countries visited.
(c) The client agrees to comply with SUNWAY's requirements with regard to his conduct and shall not in any way constitute a nuisance to any other persons on the tour.
If any client acts in contravention of the above, SUNWAY shall be entitled to terminate that clients participation on the tour without refund of any monies paid and without liability to SUNWAY or its servants or agents. In these circumstances the client shall at the clients expense and responsibility be obliged to make his own way home.
8. BAGGAGE
(a) Each client is entitled to no more than one (1) suitcase of the soft sports bag kind weighing no more than 12 kilograms. SUNWAY may refuse to carry baggage in excess of the aforesaid. (b) All baggage and personal effects are at all times at the clients risk and SUNWAY cannot accept any liability for any loss of or damage thereto.
9. TRAVEL DOCUMENTS
The client is responsible for ensuring that all necessary documents, passports, visas, health and other certificates and travel documents, including travellers cheques where applicable, are valid and effective.
10. INSURANCE
Travel, medical expenses, baggage, money and cancellation insurance is compulsory on all SUNWAY tours. The client accepts that it is his responsibility to arrange his own insurance.
11. FORCE MAJEURE
During the course of a tour, weather, road conditions, mechanical breakdowns and incidents beyond the control of SUNWAY can influence the performance of a tour. In the unforeseen event of any of these aforementioned events occurring SUNWAY shall provide the use of the vehicle, all camping equipment and crew services. Personal expenses, meals, alternative accommodation and all other resulting costs, including the cost of flying home, are to be borne by the client. We strongly recommend travel insurance.
12. LIABILITY
Note: For the purposes of this clause, the definition of SUNWAY shall include all member(s), employees and agents of SUNWAY.
(a) SUNWAY shall have no liability whatsoever for any loss, including financial loss, arising from loss of and/or damage to any property of any CLIENT, nor for loss of any nature, including financial loss, arising from the death or injury of any CLIENT, howsoever any such loss, financial loss, damage, injury or death shall arise, including negligence of any degree on the part of SUNWAY. The CLIENT hereby indemnifies SUNWAY against all claims of whatever nature brought against SUNWAY by the CLIENT, the CLIENT’S estate, or family of the CLIENT, including dependants, in respect of any personal injury, death, damage, or loss, including financial loss, of any nature howsoever caused, including negligence of any degree.
(b) Notwithstanding the above, in the event of there being a claim in law against SUNWAY, such claim shall be limited to R50 000-00 (FIFTY THOUSAND RAND) inclusive of capital, interest and costs.
13. PHOTOGRAPHY
SUNWAY reserves the right to make use, without giving any further notice, of any photograph or film produced by SUNWAY without payment or permission.
14. HEALTH
The client acknowledges being aware of the proposed itinerary and that the tour requires a certain level of physical fitness and acknowledges that he is medically fit and able to embark upon the tour.
